The DCCA Office of Administrative Hearings has denied HDCC’s second bid protest.Hawaiian Dredging filed a this protest after the HDOT claimed that their latest bid was not responsive.They asked the the OAH to award the contract to them and have the HDOT pay damages and costs resulting from that bid award.
This decision is absolutely great news. It means the HDOT can move forward to putting this project out to bid for a third time and strengthens their appeal of the HDCC’s first successful bid protest (oral arguments are scheduled for September 9, 2009 – case number #1CC0910832).
I’m happy to see that the Hawaii PUC will thoroughly scrutinize any new sale of Hawaiian Telcom.However this is too little, too late. They should’ve heeded the concerns raised and blocked Carlyle’s purchase four years ago.
Lastly, this Honolulu Advertiser op-ed asking for more transparency regarding Sandwich Isles Communications proposal to buy Hawaiian Telcom is spot-on. Hawaiian Telcom is a critical utility for the residents of Hawaii. Thus we deserve to know SIC’s financial information.
